Terms of Service

These End User Terms of Service (“Terms”) govern your access to and use of the Urban Safari interactive scavenger hunt platform and mobile and web application (the “App”), provided by Itsybits LLC under its “Urban Safari” brand (“Platform Provider,” “we,” “us,” or “our”) and operated for your event by the organization hosting it (the “Event Organizer”). By accessing or using the App, joining a Hunt, or participating in any activity through the App, you agree to be bound by these Terms. If you do not agree, do not use the App or participate in any Hunt.

1. The Service

The App enables interactive scavenger hunts and location-based experiences (“Hunts”). Hunts are created and managed by the Event Organizer, not by the Platform Provider. We supply the technology; the Event Organizer designs the experience, selects the locations, and sets the rules.

2. Who can participate

You must be at least 13 years old to use the App.

If you are between 13 and 17 years old, you may participate only if a parent or legal guardian has reviewed and accepted these Terms on your behalf — including the Assumption of Risk and Release below — and agrees to be bound by them. A parent or guardian who accepts for a minor does so on the minor's behalf and on their own behalf, and is responsible for the minor's participation, conduct, and safety.

The App is not intended for and may not be used by children under 13. We do not knowingly collect personal information from children under 13, and will delete it if we learn we have. The Event Organizer is responsible for confirming eligibility and for obtaining any parent or guardian consent required by law before a minor participates. If the Event Organizer sets additional eligibility requirements for a Hunt, those apply too.

3. Joining a game; teams

You join Hunts by entering a game code from the Event Organizer. You do not create a personal account; your participation is tied to a team name you choose. You are responsible for keeping your game code confidential and for all activity under your team.

4. Location-based activities & assumption of risk

Hunts are location-based experiences that may require you to move through public spaces, visit locations, navigate urban environments, solve clues, complete challenges, and submit photos, videos, or text while physically moving through real-world settings.

By participating, you acknowledge that: participation involves physical movement through real-world environments; it carries inherent risks, including personal injury, property damage, weather, uneven terrain, traffic, and other hazards; you are solely responsible for your own safety and situational awareness at all times; you should not participate in anything you believe to be unsafe and should stop if conditions become hazardous; neither the Platform Provider nor the Event Organizer supervises or monitors your physical movements or real-world conduct; and you participate voluntarily and at your own risk.

Lawful conduct. You must comply with all applicable laws, regulations, and posted rules. You shall not trespass on private property, enter restricted areas, obstruct traffic or pedestrian pathways, interfere with emergency services, or engage in any activity that creates an unreasonable risk of harm to yourself or others.

5. Your submissions

You may submit photos, videos, text, and other content through the App (“User Content”). You retain ownership of your User Content. By submitting it, you grant the Platform Provider a non-exclusive, worldwide, royalty-free right to use, display, reproduce, and distribute it as necessary to operate the App (including on leaderboards, live feeds, and spectator views), and you grant the Event Organizer a non-exclusive, worldwide, royalty-free right to use, reproduce, distribute, display, create derivative works of, and publish it in connection with the Event Organizer's business, including marketing and event recaps.

You shall not submit User Content that is unlawful, defamatory, threatening, harassing, abusive, or obscene; that infringes any third party's intellectual property, privacy, or publicity rights; that depicts, exploits, or endangers minors; that contains malware; or that violates any law. Neither the Platform Provider nor the Event Organizer is obligated to monitor or remove User Content, but either may do so.

6. Prohibited conduct

You shall not: use the App for any unlawful purpose; harass, threaten, intimidate, or abuse anyone, including other participants, bystanders, or the public; impersonate any person or entity; interfere with or disrupt the App or any Hunt; attempt to gain unauthorized access to the App or related systems; use the App while operating a motor vehicle; or engage in any conduct that poses an unreasonable risk of injury to yourself or others.

7. Privacy

Your use of the App is also governed by our Privacy Policy, which describes what we collect and how we use it. Where a Hunt permits participants aged 13–17, the Event Organizer is responsible for providing any additional privacy notices and obtaining any parental or guardian consents required by law before a minor's data is collected.

8. Intellectual property

The App, the “Urban Safari” and “itsybits” names and branding, and all related software, designs, features, and content (excluding User Content) are the property of the Platform Provider and are protected by intellectual property laws. You receive a limited, non-exclusive, non-transferable right to use the App solely to participate in Hunts. You shall not copy, modify, reverse engineer, decompile, or create derivative works based on the App.

9. Disclaimers

THE APP AND ALL HUNTS ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE. THE PLATFORM PROVIDER DOES NOT DESIGN, CREATE, REVIEW, APPROVE, OR CONTROL THE CONTENT, LOCATIONS, CHALLENGES, OR ACTIVITIES OF ANY HUNT — HUNTS ARE CREATED AND OPERATED SOLELY BY THE EVENT ORGANIZER — AND MAKES NO REPRESENTATIONS REGARDING THE SAFETY, LEGALITY, OR SUITABILITY OF ANY HUNT OR LOCATION.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, NEITHER THE PLATFORM PROVIDER NOR THE EVENT ORGANIZER SHALL BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, LOST PROFITS, LOSS OF DATA, EMOTIONAL DISTRESS, OR LOSS OF ENJOYMENT, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP OR PARTICIPATION IN ANY HUNT. TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE PLATFORM PROVIDER'S TOTAL LIABILITY FOR ANY AND ALL CLAIMS SHALL NOT EXCEED ONE HUNDRED DOLLARS ($100 USD). Some jurisdictions do not allow certain limitations, which apply to the fullest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless the Platform Provider and the Event Organizer, and their respective officers, directors, employees, and agents, from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of or related to your use of the App or participation in any Hunt, your User Content, your violation of these Terms, or your violation of any law or third-party right.

12. Termination

The Platform Provider or the Event Organizer may, at any time, without notice and in their sole discretion, suspend or terminate your right to access or use the App, including for breach of these Terms.

13. Third-party content and links

The App may link to or embed content from third-party services. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party sites or services. Your access to them is at your own risk.

14. Governing law and disputes

These Terms are governed by the laws of the State of Washington, without regard to conflict-of-laws principles. Any dispute arising out of or relating to these Terms or your use of the App shall be resolved by binding arbitration administered by JAMS under its Streamlined Arbitration Rules and Procedures, conducted by video conference, with a written, reasoned award.

TO THE FULLEST EXTENT PERMITTED BY LAW, ALL DISPUTES SHALL BE RESOLVED ON AN INDIVIDUAL BASIS. YOU WAIVE ANY RIGHT TO BRING OR PARTICIPATE IN ANY CLASS, COLLECTIVE, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. Notwithstanding the foregoing, either party may bring an individual claim in small claims court if it falls within that court's jurisdiction.

15. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we'll post the updated Terms here and update the version and date above. Your continued use of the App after changes are posted constitutes your acceptance.

17. Severability and entire agreement

If any provision of these Terms is held invalid or unenforceable, the rest remain in full force and effect. These Terms are the entire agreement between you and us regarding your use of the App and supersede all prior or contemporaneous understandings.
